Offers and eligibility
Sonnel Hospitality operates a loyalty rewards program, known as pubpass, for patrons of participating Sonnel Hospitality venues (Rewards Program). These terms and conditions apply to and govern our provision of the Rewards Program and your participation in the Rewards Program.
Membership of the Rewards Program is free and allows members of the Rewards Program to access certain benefits at participating Sonnel Hospitality venues. Currently, these benefits include:
- access to member pricing on eligible food and beverage purchases at participating Sonnel Hospitality venues when you present or scan your Rewards Program digital card;
- vouchers we may provide from time to time for use on food and beverages at participating Sonnel Hospitality venues;
- a special birthday offer from us, currently a $25 voucher for use on food and beverages at participating Sonnel Hospitality venues; and
- other offers or benefits we may provide from time to time.

We may add to, remove or otherwise change these benefits at any time, provided that we will use commercially reasonable efforts to provide you with reasonable notice of major changes to the benefits available as part of the Rewards Program. Some benefits may be limited or subject to availability criteria or, where benefits are in the form of promotional offers, vouchers or similar, may be subject to additional terms and conditions (including expiry dates or availability periods as notified to you).
Foundation members of the Rewards Program may receive certain ongoing benefits for as long as they remain a member of the Rewards Program, as such foundation benefits are notified at the time of joining. Sonnel Hospitality reserves the right to determine the eligibility criteria for foundation members and to cease offering foundation memberships.
At all times, your access to these benefits and your eligibility to participate in the Rewards Program is subject to your compliance with these terms and conditions and you continuing to meet the following eligibility criteria:
- you are an individual over the age of 18 years old;
- you are not excluded from the relevant participating Sonnel Hospitality venue for any reason in accordance with any of our policies or procedures;
- you have provided Sonnel Hospitality with complete and accurate information to allow Sonnel Hospitality to administer the Rewards Program and undertake the matters set out in these terms and conditions;
- you have consented to receive direct marketing communications from Sonnel Hospitality and have not opted out of receiving such communications; and
- you are not a member of the Rewards Program using any other name or contact details, as reasonably determined by us. If you have multiple Rewards Program accounts, we reserve the right to withhold any sign-up or periodical benefits otherwise available to you for any of your Rewards Program accounts.
These benefits are personal to you, and you must not use, or allow any third party to use, your Rewards Program card or membership for the benefit of another and you cannot transfer your membership benefits to a third party. You agree that a Sonnel Hospitality representative may require you to produce photograph identification for the purpose of verifying your membership at the time of the relevant transaction. Where you fail to produce satisfactory identification, Sonnel Hospitality may refuse to apply a membership benefit to the relevant transaction.
General
By signing up to the Rewards Program, you agree to be bound by these terms and conditions. We may vary these terms and conditions from time to time, provided that we will use commercially reasonable efforts to provide you with reasonable notice of major changes to these terms and conditions. If you do not agree to the varied terms and conditions, you can terminate your membership at any time in accordance with these terms and conditions.
It is your responsibility to protect your Rewards Program digital card, and you must take reasonable precautions against any unauthorised use.
Membership of this Rewards Program does not automatically give you a right of entry into the relevant participating Sonnel Hospitality venue, or any other venue owned or operated by Sonnel Hospitality, or a right to enter into any transaction for food or beverages. Sonnel Hospitality reserves the right to refuse any person entry to its venues or relevant food or beverage transactions in accordance with its policies and applicable laws and regulations.
You must not provide false or misleading information to us. Sonnel Hospitality reserves the right to disqualify, suspend or cancel any benefits obtained or accrued by any member who does not comply with these terms and conditions.
We may set reasonable rules and policies regarding the Rewards Program and/or your participation in the Rewards Program and you must comply with all such rules and policies that we notify you of. If you do not agree to any additional rules and policies, you can terminate your membership at any time in accordance with these terms and conditions.
Suspension and termination
Sonnel Hospitality reserves the right at its sole discretion to cancel, terminate, modify or suspend this Rewards Program, and will notify you before doing so.
Sonnel Hospitality may terminate your membership immediately by providing you with written notice if:
- it becomes aware that you do not, or did not at any time during your membership, meet the eligibility criteria for the Rewards Program;
- it reasonably considers that you have used your membership fraudulently or otherwise in contravention of these terms and conditions or the law generally;
- you have not used your Rewards Program card for a period of 24 months; or
- you notify us that you want to cancel your membership of the Rewards Program.
You can cancel your membership of the Rewards Program at any time by providing us with written notice (including by email to [email protected]). Such termination will take effect within 14 days, or earlier once processed by us and notified to you. If your membership is terminated or Sonnel Hospitality no longer offers this Rewards Program, you will not be able to receive or redeem the benefits, including any accrued benefits.
Liability
To the maximum extent we are permitted to do so by law, including the Australian Consumer Law, we exclude from these terms and conditions any term (including any representations, conditions and warranties), guarantee or right that may be implied or imposed, whether by statute, general law or custom. This does not apply in respect of any term, guarantee or right implied or imposed by law for which we are not able to exclude or limit our liability (a Non-Excludable Provision).
Except in respect of Non-Excludable Provisions, you agree that we are not liable to you or anyone else for any loss or damage (including, without limitation, any direct, indirect, special or consequential loss), whether in tort (including negligence) or otherwise arising out of, or in connection with:
- your membership to, and access and use of, the Rewards Program, including any of its offers or benefits; and
- your inability to access or use the Rewards Program Pass, including its offers or benefits, however arising, including (without limitation) negligence.
If any Non-Excludable Provision applies and Sonnel Hospitality is able to limit your remedy for a breach of the Non-Excludable Provision, then Sonnel Hospitality’s liability for breach of the Non-Excludable Provision is limited exclusively (so far as applicable laws do not prohibit) to, at Sonnel Hospitality’s option: (a) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again; and (b) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or acquiring equivalent goods, or the payment of the cost of having the goods repaired.
General terms
Where any provision of these terms and conditions is prohibited by law or judged by a court to be unlawful, void, or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions of these terms and conditions.
Sonnel Hospitality reserves its right to waive, in respect of any member or members (at our discretion), any right or requirement in these terms and conditions and/or the application of, or compliance with, any of these terms and conditions. Where Sonnel Hospitality exercises this waiver, this does not operate as a waiver of such right, requirement, application, or compliance if it arises again.
This document is governed by the laws of New South Wales. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and of any court that may hear appeals from any of those courts, for any proceedings in connection with these terms and conditions.
Definitions
Australian Consumer Law has the meaning given in the Competition and Consumer Act 2010 (Cth).
Sonnel Hospitality, we, us, our means Nelmeer Hoteliers Pty. Limited ABN 15 060 977 022.
You means any person who participates in the Rewards Program.
Privacy collection statement
In operating our Rewards Program, Sonnel Hospitality will collect and handle your personal information. We may collect the following information at the time of receiving your membership request or administering the Rewards Program:
- contact and identification information such as your name, photograph, date of birth, address, telephone number and email address;
- information regarding your transactions with us, including reservations and bookings you make, ordering history, food or beverage or other dining preferences, use of vouchers or other offers and attendance at Sonnel Hospitality venues, regardless of whether you present your rewards card at the time of a relevant transaction; and
- any query, feedback or review that you submit to us regarding your experience at Sonnel Hospitality venues or in relation to our Rewards Program.
We will generally collect this information directly from you, but may collect it from others from time to time, including our service providers or other members of our group. We may also combine this personal information with other information we hold about you, in order to derive new personal information about you, such as insights and opinions about your habits and preferences.
We collect this personal information from you for the following purposes:
- to provide, administer, assess, customise and improve our Rewards Program and our hospitality services;
- to verify your identity and compliance with these terms and conditions;
- to respond to any queries or feedback you submit to us;
- to manage our relationship with you;
- to administer, support, improve and develop our business and the products and services we offer, including by undertaking data analytics and related activities;
- to provide you with promotional, marketing and other material, including promotional and marketing material delivered via email, SMS and targeted online content, related to the Sonnel Hospitality group, including promotions, offers or events, in relation to the Sonnel Hospitality venue in question, other Sonnel Hospitality venues or events, and/or third party services that may be of interest to you; and
- to comply with any applicable laws or regulations.
We may disclose your information to other members of the Sonnel Hospitality group and to other parties for the purpose of operating and maintaining our Rewards Program, including our service providers and professional advisers. Some of these parties may be located outside Australia, including technology service providers located in China, India and Canada.
If you do not provide the personal information requested by us or provide incomplete or inaccurate information, we may be limited in how we can interact with you and some of the features of the Rewards Program may not be available to you.
Our privacy policy, available at https://sonnel.com.au/privacy-policy/, sets out further details of how we will collect, store, manage, use and disclose your personal information. The privacy policy also contains information about how you can access and seek correction of the personal information held by us, how you can complain to us about a breach of the Privacy Act 1988 (Cth) and how Sonnel Hospitality will respond to and deal with such a complaint.
